a. All prices specified by WRT shall be subject to change at any time by WRT due to seasonal adjustment, changes in
the price of fuel or other operators altering their prices at any stage. Any price changes applicable to your booking will
be promptly notified to you by WRT. The price of your experience shall not change after the date on which payment
has been made in full by you in relation to your booking.
b. All prices are in NZ$ and include GST.
a. Upon accepting an itinerary from WRT whether in writing or verbally you acknowledge that you have read WRT Terms
and conditions and you understand and accept them in their entirety.
b. A 25% deposit is required within 7 days of confirming your booking to secure bookings for accommodation, bikes and
transport and any other services that we offer.
c. By paying your deposit you take responsibility for your itinerary; you acknowledge that you have read your itinerary
thoroughly and that it is as you requested i.e. dates, accommodation, transport timing and bookings.
3. Balance of Payment of Your Booking
a. Full payment is required no less than 2 working days before your booking start date.
b. We accept Visa, Mastercard and payments via direct bank credit. If these payments are not suitable, please make
contact with us to discuss other options.
c. As from the 1st March 2012, if you are settling your account with a credit card, a service fee will apply. The current fee
is 2% in addition to the total amount payable for all types of credit cards. Payments by cash or EFTPOS do not attract
d. No refunds will be made for early returns, late pick ups, no shows or changing your mind on the day of pick up.
4. Transport Arrangements
a. WRT transport schedules are designed as a guide to the times we will try to adhere to but they may vary dependent
upon the differing requirements of clients that have to be met, the difficulties that can arise in transiting remote
country areas and the variations in our transport load on any given day. For example, it must be accepted that our
drivers are required where possible to offer ad hoc assistance to clients who have problems out on the trail.
b. We will endeavour to meet our schedules and your specific travel requirements as closely as possible but we can in
no way guarantee precise pick up and drop off times.
5. Bike Transport
There is a $5 per bike transport fee per one way trip for any bikes where WRT is required to transport a bike.
6. Group Numbers
a. It is the WRT policy to deal with only one person organising a group (2+ people).
b. WRT prefers that all bookings and/or amendments to itineraries are communicated through email so that records of
what has been discussed can be retained. WRT accepts no responsibility for discrepancies in any bookings or
variations to itineraries made verbally in any way.
c. Group payment is required in one transaction for all members of a group i.e. on one credit card, in one direct credit
bank payment. If this is not suitable, please make contact with us to discuss other options.
7. Variation by Waikato River Trails
a. WRT reserves the right to vary any itinerary at any time up to and following your departure date.
b. You will be notified promptly of any such variation.
c. If a variation results in a substantive change to your itinerary, as determined by WRT, you will have the option of:
i. Continuing with the varied itinerary without a reduction in price;
ii. Accepting any alternative arrangements offered to you by WRT, in which case any difference in price will be
payable by you or refunded by WRT (as applicable);
iii. Transferring to another time (subject to availability), in which case any difference in price will be payable by you or
refunded by WRT (as applicable);
iv. Cancel your booking whereby you will be given a full refund of all amounts paid to WRT in respect to such booking,
excluding variation fees and any additional fees as applicable, provided that notification of your decision to cancel
is received in writing by WRT no later than seven days from the date on which WRT notified you of the substantive
change to your itinerary.
v. WRT reserves the right to close trails at any time.
8. Cancellation by You
a. Except as otherwise specified in these Terms, in the event of cancellation of a booking by you, the following fees shall
i. Cancellations will require notification to be done in writing by the person booking the experience.
ii. A cancellation 7 working days or more prior to the departure will result in a loss of 50% of the deposit.
iii. Cancellations made between 7-2 working days prior to departure will result in 100% loss of deposit.
iv. Cancellations made between 2 working days and 4pm the day prior to the start of the booking will result in a 50%
loss of the full booking cost.
v. Cancellations made after 4pm the day prior to the start of the hire will result in a 100% loss of full booking cost.
b. Cancellation fees are payable to WRT immediately upon confirmation of cancellation by you, conveyed only in writing
to WRT. WRT may offset any amounts it holds in respect of your booking against cancellation fees owed to WRT
pursuant to these Terms.
9. Variation or Amendment by You
a. From the date of confirmation of your booking you will be allowed one variation or amendment to your itinerary after
which any variations or amendments to your booking requested by your group, for any reason shall incur a fee of
$25.00 payable at the time that such variation is requested.
b. We will allow you to transfer the booking to another date subject to availability.
10. Health Requirements
a. Payment of your deposit to WRT shall constitute a warranty by you that you and any other persons covered by your
booking, are physically fit and able to participate in WRT activities and have not been advised otherwise by a qualified
b. That you understand that under New Zealand law the accident compensation scheme provides only limited assistance
to visitors to New Zealand who suffer personal injury. WRT strongly recommends that all visitors to New Zealand
should have full insurance covering any personal injury they might suffer, including medical treatment cover.
a. You, the customer accept that the activities offered by or through Waikato River Trails Charitable Trust (hereafter WRT),
inherently involve risks and potential hazards.
b. You agree that by undertaking the activities, you accept that there are risks and hazards associated with the activities.
You also confirm that all persons travelling with you on this itinerary have been informed about the terms of this waiver
and in undertaking the activities, have similarly agreed to accept that there are risks and hazards associated with the
activities and to accept the terms of this waiver.
c. You accept that it is reasonable for WRT to assume that you have accepted these terms and conditions by purchasing
and undertaking the activity.
d. To the extent permitted by law you hereby release, waive, discharge and hold blameless WRT, WRT staff and all
persons entities and contractors connected to WRT from any and all liability for death, disability, personal injury
(including mental injury), property damage, property theft, loss of personal equipment and all other foreseeable risks,
claims or actions of any kind (including negligence) whatever and however occurring which may arise (including
consequential loss or damage), at any time, from or in connection with, directly or indirectly, as a consequence of you
carrying out the activities of WRT. You note that this exclusion is subject to any rights or remedies you may have under
the Consumer Guarantees Act 1993.
e. You also agree to indemnify WRT regarding any injury, loss, damage or cost (including consequential loss or damage)
and other liabilities of any nature suffered or incurred by anyone else as a direct or indirect result of any act or omission
(whether negligent or otherwise) by you.
f. You agree that this waiver and indemnity is contractually binding on yourself, your successors, your executors,
administrators, heirs, next of kin and assigns and that should you or any of your successors, executors, administrators,
heirs, next of kin or assigns assert a claim in contravention of this waiver the asserting party shall be liable for all the
expenses (including legal fees on a solicitor client basis) incurred by the other party or parties in defending the claim.
a. These Terms shall be subject to amendment by WRT from time to time.
b. The failure of WRT to enforce any provision of these Terms shall not be treated as a waiver of that provision, nor shall it
affect WRT future right to enforce that provision.
c. Additional terms and conditions may apply to your booking and will be advised by your WRT representative at the time
of booking or variation thereof.
d. If a dispute arises between you and WRT in connection with any booking and/or these terms, the parties undertake in
good faith to use all reasonable endeavours to settle the dispute by way of good faith negotiations.
e. If any provisions of these Terms is, or becomes, unenforceable, illegal or invalid for any reason it shall be deemed to
be severed from these Terms without affecting the validity of the remainder of the Terms and shall not affect the
enforceability, legality or application of any other provision of these Terms.
f. These Terms constitute the entire agreement between the parties about its subject matter and any previous
agreements, understandings and negotiations on that subject matter has no effect.
